Agreement for Web-based education through Internet

 

THIS AGREEMENT is entered into on this day of year by and between Tamil Virtual Academy represented by its Chairman, functioning at Anna University Campus, Gandhi Mandapam Road, Kottur, Chennai - 600 025, India hereinafter called the party of the first part, and ................................................................................................... ................................................................................................... ................................................................................................... ................................................................................................... ....................................................., represented by ................................................................................................... ................................................................................................... ............................... hereinafter called the Franchisee/Agent and

 

Whereas, Tamil Virtual Academy (TVA) is offering web-based education in Tamil through Internet and had decided to appoint local franchisees more in the nature of contact centers to provide necessary counselling and guidance to the local students as decided by Tamil Virtual Academy and

 

Whereas,.................................................................... ................................................................... the agent/franchisee has approached Tamil Virtual Academy for making it as a franchisee and to act as an agent for and on behalf of Tamil Virtual Academy and to aid local students in the web based education and

 

Whereas, the Tamil Virtual Academy has decided to appoint the above named organization as one of the franchisees for the local Center at ........................................................................................... ........................................................................................... ........................................................................................... ........................................................................................... ..................................................................................... (Name of the place/Country) on the following terms and conditions to be observed by the franchisee or agent.

 

The terms and conditions are as below :

 

  1. The Franchisee/Agent should be a Registered / Recognized institution of its respective country.
  2. The recognition certificate from the respective government and supporting documents of their educational activities should be submitted.
  3. Contact center will not be permitted under individual name.
  4. To register a new contact center the new center should be minimum 50 kms away from the existing active contact center.
  5. The contact centers which are not active for more than three years shall be considered as inactive.
  6. An adequate infrastructure for academic activities with sufficient number of qualified faculty and Internet connectivity computer systems should be maintained in the contact center.
  7. No registration fee is collected to register a contact center.
  8. For every student registered with the contact centers in India shall remit a course Registration fee as Rs. 400/= per paper and examination fee as Rs. 150/= per paper and in other foreign contact center shall remit a course Registration fee as US $ 15/= per paper and examination fee as US $ 5/= per paper, from each student willing to take examination. Out of the examination fees collected 60% may be utilized by the contact centers for the expenses related to postal and other administrative expenses.
  9. Contact center in India shall remit Rs. 150/= per paper and other foreign contact centers US $ 5/= per paper as late fee for belated payment of examination fees.
  10. Diploma/Higher Diploma/Degree certificates may be received on payment of Rs.400/- as certificate fee. The students who have registered in Sri Lanka will get 50% discount on certificate fee.
  11. Registration and examination fee paid is not transferable or refundable.
  12. Candidates living in Gulf Countries and Sri Lanka will get 50% discount in the Registration Fees.
  13. Duplicate certificates for the successfully completed students may be issued on request, contact centers in India should pay Rs. 300/= and other foreign contact center should pay US $ 10/=. Besides Rs. 400/= shall be paid for receiving Diploma/Higher Diploma/Degree course certificate.
  14. The fee structure specified above is subject to modification from time to time.
  15. The administrator or a designated representative of the contact center is responsible for all Academic activities. The close relatives of the student should not be engaged in examinations process.
  16. All information related to academic activities shall be informed to contact centers through the mail id specified in the MoU only.
  17. TVA, Chennai may also act as an examination center for any student.


The Franchisee or agent shall be very sincere and shall strive their level best to promote the ideologies of the TVA. The Franchisee shall not make any mal advertisement about TVA and incase such matters come to the knowledge of TVA, this agreement will get cancelled and TVA will have the rights to sue the Franchisee and shall eligible to claim damages.

 

In case of any disputes arising out of this agreement or touching upon the terms of this agreement, the parties hereto, the courts in Chennai, Tamilnadu, India shall have jurisdiction to try and decide the issue.

 

In respect of the terms and conditions not written above, the same shall be agreed upon mutual discussion.
